How We Make Magic Without Losing Our Marbles - Client terms and conditions
Effective Date: 3 August 2026
Last Updated: 3 August 2026
Introduction
Welcome to Bonehead Design.
Great design is built on collaboration, clear communication and a little bit of creative chaos. To make sure every project runs smoothly, these Client Terms & Conditions outline how we work together, what you can expect from us and what we need from you.
These terms apply to all branding, graphic design, website design and related creative services provided by:
Steven Davies-Evans trading as Bonehead Design
By booking a project, approving a quotation or making payment, you agree to these Client Terms & Conditions.
If anything is unclear, please ask before the project begins. Clear expectations make for better work and a much smoother creative process.
Working With Bonehead Design
Bonehead Design provides creative services including:
• Brand identity design.
• Logo design.
• Graphic design.
• Website design.
• Digital design services.
• Other creative services agreed between Bonehead Design and the client.
Every project is different, so the exact services, deliverables, timelines and costs will be confirmed within a quotation or written agreement before work begins.
Project Enquiries and Quotations
Initial enquiries, discussions and discovery calls help us understand your goals, requirements and expectations.
Following this process, Bonehead Design may provide a quotation outlining:
• The agreed services.
• Project deliverables.
• Estimated timeline.
• Project cost.
• Payment schedule.
• Any specific terms relating to the project.
Quotations are valid for the period stated within the document. If no expiry date is provided, quotations will remain valid for 30 days from the date issued.
A project will only be scheduled once the quotation has been accepted and any required deposit has been received.
Booking and Project Start
A project booking is considered confirmed once:
• The quotation has been approved.
• The required deposit has been paid.
• Any necessary project information has been provided by the client.
Work will not begin until these requirements have been completed.
Project start dates are subject to availability and may change where information, approvals or payments are delayed.
Payments and Deposits
Bonehead Design requires payment to secure project availability and begin work.
Unless otherwise agreed in writing, all projects will follow the payment structure below:
• A 50% deposit is required before any work begins. This payment confirms the booking, secures time within the Bonehead Design schedule and allows the project to commence.
• The remaining 50% balance is due once the project has been completed, approved by the client and before any final files, editable artwork, website access, launch credentials or completed deliverables are released.
Final deliverables will not be supplied until full payment has been received.
The initial deposit is non refundable once work has commenced, as time, planning, research and creative resources will have already been allocated to the project.
Final Approval and Release of Deliverables
Before final payment is made, the client will have the opportunity to review the completed project against the agreed scope of work.
Once the project has been approved and the remaining balance has been paid, Bonehead Design will provide the agreed final deliverables.
Ownership or usage rights for final approved work will only transfer in accordance with these Client Terms & Conditions once payment has been received in full.
Failure to complete the final payment may result in final files, website access, source files or other deliverables being withheld until the outstanding balance has been settled.
Invoices
Invoices will be issued by Bonehead Design and must be paid according to the payment terms stated on the invoice.
Payment is accepted via bank transfer (BACS) unless otherwise agreed.
The client is responsible for ensuring payment details are entered correctly and that payments are made on time.
Any additional costs agreed outside the original project scope will be invoiced separately.
Late Payments
Payment deadlines are important because delays can affect project schedules and availability.
If payment is not received by the agreed due date, Bonehead Design reserves the right to:
• Pause work on the project.
• Delay delivery of completed work.
• Remove the project from the active schedule until payment has been received.
• Charge any applicable interest or recovery costs where permitted under UK legislation.
Work will resume once outstanding payments have been received and the project schedule has been reviewed.
Client Responsibilities
Great creative work is a team effort. To keep projects moving smoothly, clients are responsible for providing:
• Clear project information.
• Accurate business details.
• Required content, images, copy or materials.
• Timely feedback and approvals.
• Access to any platforms, accounts or resources required to complete the project.
Delays caused by missing information, late feedback or unavailable approvals may affect project timelines.
Bonehead Design is not responsible for delays caused by circumstances outside of our reasonable control or where required information has not been provided by the client.
Communication
Clear communication helps create better results.
Bonehead Design will communicate primarily through email unless another method has been agreed.
Clients should ensure that contact details provided are accurate and that project communications can be received.
We aim to respond to client messages within a reasonable timeframe during normal working hours. Response times may vary depending on workload, project deadlines and availability.
Feedback and Approvals
Client feedback is an important part of the creative process.
Feedback should be provided clearly and constructively, with all relevant comments collected together wherever possible.
Approvals or decisions made by the client will be considered final for the relevant stage of the project.
Failure to provide feedback within a reasonable timeframe may result in project delays and potential changes to the original schedule.
Design Concepts and Creative Direction
Bonehead Design aims to create thoughtful, strategic and effective design solutions based on the information, goals and direction discussed during the project.
The creative process may include research, exploration, concepts, refinements and final production depending on the agreed service.
Design concepts are created specifically for the agreed project and should not be reproduced, modified or used until final approval and payment have been completed.
Initial concepts are intended to explore creative directions and may not represent the final approved design.
Bonehead Design reserves the right to make creative decisions based on professional experience, design principles and the agreed project objectives.
Revisions and Changes
The number of included revisions will be outlined within the original quotation or project agreement.
A revision refers to reasonable adjustments to an existing concept or design direction. It does not include completely changing the original brief, requesting additional concepts outside the agreed scope or starting a new direction.
Examples of additional work may include:
• Changing the project direction after approval.
• Requesting new concepts beyond the agreed amount.
• Adding new pages, features, designs or deliverables.
• Providing unclear or conflicting feedback requiring additional development time.
Additional revisions or work outside the agreed scope may be charged separately at the applicable hourly rate or through an additional quotation.
Changes to Project Scope
Every project begins with an agreed scope of work. If requirements change during the project, Bonehead Design will discuss the impact on:
• Cost.
• Timeline.
• Deliverables.
• Project requirements.
No additional work will be completed outside the agreed scope without approval from the client.
Where additional work is requested, Bonehead Design may provide an updated quotation or invoice before proceeding.
Client Approval
The client is responsible for carefully reviewing all designs, content, spelling, information and functionality before approving final work.
Once final approval has been provided, Bonehead Design is not responsible for errors, omissions or changes requested after approval unless otherwise agreed.
Clients should ensure that all necessary stakeholders within their business have reviewed and approved the work before providing final sign off.
Ownership of Final Designs
Once full payment has been received, ownership of the final approved deliverables will transfer to the client as outlined within the agreed project scope.
Ownership applies only to the final approved work created specifically for the client.
Unless otherwise agreed, ownership does not include:
• Unused concepts.
• Alternative design options.
• Working files or internal development files.
• Design processes, methods or techniques.
• Third party assets or licensed materials.
Bonehead Design retains ownership of all original creative approaches, processes and non client specific resources used during the project.
Source Files and Editable Artwork
Where applicable, editable source files may be included within a project package or provided as an additional service.
If source files are not included within the agreed deliverables, Bonehead Design is not required to provide working files.
This may include:
• Adobe Illustrator files.
• Photoshop files.
• InDesign files.
• Development files.
Final exported files suitable for the agreed use will be supplied according to the project agreement.
Fonts, Images and Third Party Assets
Creative projects may include third party assets such as fonts, stock images, icons, software elements or other licensed materials.
Where third party assets are used, they remain subject to the original creator's or provider's licensing terms.
Bonehead Design will make reasonable efforts to ensure that any licensed assets are used appropriately within the agreed project.
Unless otherwise stated, the client is responsible for obtaining any additional licences required for uses outside the original project scope.
Examples may include:
• Using a font across additional platforms or locations.
• Expanding usage rights beyond the agreed purpose.
• Using stock imagery in additional marketing materials.
• Transferring licensed assets to another organisation.
Bonehead Design is not responsible for licensing requirements that fall outside the agreed project deliverables.
Client Supplied Materials
Clients are responsible for ensuring that any materials supplied to Bonehead Design are legally permitted to use.
This may include:
• Logos.
• Images.
• Written content.
• Brand assets.
• Photography.
• Videos.
• Other intellectual property.
By supplying materials, the client confirms that they have the necessary rights, permissions and licences to use those materials.
The client agrees to protect and hold Bonehead Design harmless from claims arising from the unauthorised use of client supplied materials.
Website Design Services
Where Bonehead Design provides website design services, the project scope, deliverables and responsibilities will be outlined within the original quotation.
Website projects may include services such as:
• Website structure and layout.
• Page design.
• Content placement.
• Responsive design.
• Basic search engine optimisation setup.
• Platform configuration.
The final website functionality may depend on third party platforms, software and services used within the project.
Website Platforms, Hosting and Domains
Bonehead Design may create websites using third party platforms, including website builders, hosting providers or other digital services.
These platforms are owned and operated by third parties and are subject to their own terms, pricing structures and limitations.
Bonehead Design is not responsible for:
• Changes made by third party platforms.
• Platform downtime or outages.
• Changes to pricing or features.
• Security issues outside of our control.
• Loss of access caused by incorrect client account details or permissions.
Where a client purchases their own domain, hosting or platform subscription, they remain responsible for maintaining their account and payment details.
Website Performance and SEO
Bonehead Design aims to create websites that are visually effective, user friendly and built with good design practices.
Where SEO services are included, Bonehead Design may provide basic optimisation such as:
• Page structure recommendations.
• Metadata setup.
• Image optimisation guidance.
• Search friendly content structure.
However, Bonehead Design does not guarantee specific search engine rankings, traffic levels, leads or commercial results.
Search engine performance depends on many external factors, including competition, content quality, industry changes and search engine algorithms.
Website Care Plans and Ongoing Support
Where Bonehead Design provides ongoing website support, maintenance or care plans, the details of the service will be agreed separately with the client.
Ongoing support may include:
• Website updates.
• Content changes.
• Technical checks.
• Minor design adjustments.
• General website assistance.
Care plans do not include unlimited design work, new website builds, major redesigns, extensive development work or additional services unless specifically agreed.
Requests outside the agreed support package may be quoted separately.
Where ongoing support is provided through third party platforms, the continued availability and functionality of those platforms remains subject to the provider's own terms and conditions.
Portfolio and Marketing Rights
Bonehead Design reserves the right to showcase completed projects, designs and creative work for promotional purposes unless otherwise agreed in writing.
This may include:
• Portfolio websites.
• Social media.
• Case studies.
• Design awards.
• Marketing materials.
Where a client has requested confidentiality or where a project contains sensitive information, Bonehead Design will respect those requirements.
Bonehead Design may also credit the client and reference the project as part of its professional portfolio.
Cancellation and Termination
Either party may request to end a project by providing written notice.
If a client cancels a project after work has begun:
• Any completed work up to the cancellation date remains payable.
• Deposits remain non refundable.
• Any outstanding costs relating to completed stages of work may become immediately payable.
Where a project is paused due to client inactivity, missing information or delayed payments, Bonehead Design reserves the right to reschedule the project based on availability.
If a project remains inactive for an extended period, Bonehead Design may consider the project closed. Any future work may require a new quotation.
Unforeseen Circumstances
Bonehead Design will always aim to deliver projects within agreed timescales.
However, we are not responsible for delays caused by circumstances outside of our reasonable control, including:
• Technical failures.
• Third party service issues.
• Illness or emergencies.
• Changes to laws or regulations.
• Events beyond our reasonable control.
Where possible, Bonehead Design will communicate any delays and work with the client to find a suitable solution.
Professional Relationship
Great creative work happens when both sides work together.
Bonehead Design is committed to providing a professional, collaborative and enjoyable experience. In return, clients are expected to provide clear communication, timely feedback and respect for the creative process.
We believe the best projects come from trust, transparency and a shared goal of creating something genuinely brilliant.
